006 - PR Freelancing & AB5: What to Know

The AB5 law that went into effect January 2020 has caused a lot of confusion and concern for California-based freelancers across the board. But, what is this law and does it apply equally to all 1099’s or are there exemptions depending what industry you’re in and how your business is structured? What does this mean for PR consultants and the clients or agencies they work with? These are only a few of the questions being asked, and to get answers we’re joined by Charles Swain, ESQ with Swain Law Firm, a practice that specializes in labor and employment disputes. Mr. Swain, walks us through the history of the law, the implications for 1099’s, and the way PR freelancers, especially if subcontracting, can pass the ABC “sniff test”.
